As an asbestos removal business (class B, class A) do workers need health monitoring?

During our asbestos removal training courses we emphasize the dangers of asbestos, we know that scientific research has proven asbestos exposure leads to diseases such as asbestosis, pleural plaques and the always fatal mesothelioma. To ensure our controls are effective we complete asbestos health monitoring, not only is it good practice but it is also the law.

Under the WHS Regulation 2011 section 435 states:

435 Duty to provide health monitoring

(1) A person conducting a business or undertaking must ensure that health monitoring is provided under section 436 to a worker carrying out work for the business or undertaking if the worker is—

  1. carrying out licensed asbestos removal work at a workplace and is at risk of exposure to asbestos when carrying out the work; or
  2. is carrying out other ongoing asbestos removal work or asbestos-related work and is at risk of exposure to asbestos when carrying out the work. Maximum penalty—60 penalty units.
